Licensing Guide

RIGHTS AND CLEARANCE

Why do you need to read this?

Rights and clearance will provide information on:

  • how you can use a video clip;
  • where you can distribute the material;
  • on which platforms; and
  • for how long.

If these elements are not closely reviewed, there could be issues with the legality of using these clips.

An understanding of these elements will protect you and your client against any legal claims due to potential copyright violations. See below for further information on clip usage:

1) What is Royalty Free footage?

Royalty Free (RF) footage can be used:

  • in any project;
  • any number of times;
  • for any duration; and
  • in any country.

There is no need to purchase an additional licence or pay further fees; the single price reflects the entire clip usage scope.

Note that any project refers to all projects with the exception of prohibited uses, including defamatory, libellous, pornographic or otherwise unlawful use of the footage.

On our website, all RF clips have the same pricing structure. The 3 prices apply to low-res clips, medium-res clips and high-res clips.

This covers notes as above but also includes prohibited use within advertising or promotional projects; which includes commercials, films, entertainment or factual programming (including online), corporate and gaming.

2) What is Rights Ready footage?

Rights Ready (RR) footage can be used in a single project for a determined fee. On our website, RR pricing is defined using our drop down menu in the clip page.

The menu is split into Use, Media, Territory and Term, i.e:

  • Use - what are you using it for?
  • Media - how are you using it?
  • Territory - in which region?
  • Term - for how long?

Our current online options are as follows, of which you will need to select the appropriate option from the drop down menu in each box:

Use - Advertising, Feature, Entertainment, Factual, Editorial, Gaming, Corporate

Media - All Media, Broadcast, Non-broadcast, Internet/digital, Public service, Feature trailer, Feature film, Documentary trailer, Documentary film, TV/digital programming, Factual productions, News/Video News Releases, Computer games, Corporate events/shows, Internal

Territory - National or Worldwide

Term - Up to 2 years or In perpetuity

In perpetuity means forever.

CORPORATE (NON-BROADCAST)

  • All media, external internal promotions on a single project: Corporate events (presentations, conventions, shows, meetings and other events). Web portals, web communication, digital interaction (emails, websites, and other digital) Internal corporate use
  • Internet corporate communication on a single project: Web portals, web communication, digital interaction (emails, websites, digital)
  • Corporate events on a single project: Presentations, conventions, shows, meetings and other events. Internal corporate use on a single project

EDITORIAL

  • News programming
  • Video news releases
  • Documentaries

GAMING
Includes computer games and related activities on a single project

3) What is Rights Managed footage?

Rights clearance will most likely be needed for Rights Managed footage, hence we ask you to contact us to gather more information about your project and usage. Here, the price is calculated on the basis of use, media, territory and term, on a case-by-case basis.

We base these clip costs on camera format, rarity of the footage, on difficulty to obtain the material and on clearance aspects (further charges could be applied for gaining clearance).

CLEARANCE

Our clearance filters are divided into Commercial use and Editorial use. In most cases, we will have signed release forms for property usage (buildings, homes, company branded buildings, government premises etc) and people usage (individuals, actors, models etc) - these clips can be used for Commercial purposes. However some clips may not need the permission of the rights holders - these are normally used for Editorial projects. See some examples below, for clarity on Commercial vs Editorial use:

Commercial use - Advertising projects, Feature films, Entertainment programming, Corporate projects, Computer gaming - where the user is making an income from selling or promoting a product or service. It could also apply to users trying to raise money, by showing this clip or project.

Editorial use - News broadcasts (TV, digital, online, mobile), Documentaries, Factual programming - on a subject that is of interest to the public, where the user is not gaining any financial returns from this clip or project, whether commercially or individually.

- you found the perfect clip but you need it for Commercial use and it's marked as Editorial use only, please contact us and we'll do our best to offer clearance assistance.

- for additional seconds on a particular clip, these will be costed on a pro-rata basis
- some clips will be offered in 2K and 4K footage formats (as shown in search result filers), but we do not store these clips online as they take up huge amounts of storage space! However, we are able to send them via ftp or physical delivery, after purchase.
